
Maine Hockey Club Queen of Hearts Raffle

Rules and Regulations for the Queen of Hearts Raffle:
All proceeds raised by the raffle will benefit Maine Hockey Club. The Raffle Official Rules and Regulations are set forth below. By purchasing a Raffle ticket, the purchaser acknowledges that they are aware of, and agrees to be bound by, these Official Rules and Maine Hockey Club’s interpretation of any such Official Rules. Maine Hockey Club shall be solely responsible for interpreting and applying the Official Rules. Maine Hockey Club’s interpretation and application of such rules shall be final. Maine Hockey Club reserves the right to amend these Official Rules upon ten days’ notice provided pursuant to an update provided on Maine Hockey Club’s website. Maine Hockey Club has registered with the City of Des Plaines.
• Eligibility: Any individual who is 18 years of age or older at the time the Ticket is purchased is eligible to enter the Raffle.
• Raffle Board: The Queen of Hearts game uses a manufactured board developed specifically for this Raffle. The board has a poker deck of 54 face down sealed numbered cards, which includes 2 jokers. The Queen of Hearts is randomly placed during production.
• Prize: The jackpot is a progressive 50/50 Raffle. Money added each week from ticket sales will accumulate until the Queen of Hearts is drawn or until the jackpot reaches $200,000, whichever comes first. The Board resets when the Queen of Hearts OR the second Joker is revealed.
o If any other queen is revealed, the ticket owner wins $100.
o If a Joker is revealed, the ticket owner wins $50.
o When neither the Queen of Hearts, a joker, or any other queen is revealed, the ticket owner will win a gift card to Beacon Tap.
o Total Prize updates will be displayed on the Maine Hockey Club website at mainehockey.org and at the Beacon Tap.
• Cost: Tickets are $5 each.
• How To Enter: Tickets are available for purchase every day at Beacon Tap (1374 Lee St., Des Plaines, IL 60016).
o All Sales at the Beacon Tap will promptly end at 6:45pm the night of the drawing.
o All Sales of tickets are FINAL.
o Any ticket with stickers, labels, or coloring of any sort, or modified in any way will be disqualified.
o Any ticket with an invalid Board number will be disqualified. Only numbers 1-54 which have not yet been revealed are qualified.
o Any ticket with no number indicated will be disqualified.
o Only ONE eligible person may be entered in the Raffle per Ticket sold.
o An individual can purchase as many Tickets as they wish, subject to availability.
• Raffle Drawings: Will be conducted every THURSDAY at 7pm by a representative of Maine Hockey Club at the Beacon Tap. ONE Ticket will be selected in a random drawing from all Tickets sold that week. The board number on the Ticket will determine which of the 54 cards on the board is opened.
o If the Queen of Hearts is not selected, the game will roll over to the next week. That card will remain face up and that board number is unavailable for future selection.
o Each week, all other Tickets not selected will be destroyed
o Entrants need not be present to win
o In the event the drawing cannot be conducted at the date, time, or location advertised by Maine Hockey Club for any reason, representatives of Maine Hockey Club shall set a new date and location for subsequent drawing.
• Notification of WINNERS: As a condition of its right to collect a Prize and become an Official Winner, any Potential Winner must deliver to Maine Hockey Club: (a) a signed statement certifying that the Potential Winner is the rightful owner of the winning Ticket or provide Ticket receipt in accordance with these Official Rules and all applicable laws. Winners will be notified according to the contact information provided to Maine Hockey Club at the time of the Ticket purchase. If a selected winner is unable to be contacted or located after reasonable attempts by Maine Hockey Club, or if the Prize cannot be awarded for any other reason, representatives of Maine Hockey Club shall conduct another drawing and select another Ticket in order to identify a Potential Winner. In order to collect a prize, winner must sign and deliver to Maine Hockey Club: (a) such written information as is required by any applicable tax and/or real estate laws, including, without limitation, Social Security Number; (b) proof of identity in forms satisfactory to Maine Hockey Club, showing that the person claiming the prize is the same person who is named on the winning Ticket. Winners may be required to submit a W-2G, Form 5754 or similar tax form (provided by Maine Hockey Club) for tax withholding purposes and may be required to pay withholding tax in an amount required by IRS regulations.
• The Maine Hockey Club treasurer will use the appropriate forms to report winnings and withhold any applicable federal and/or state taxes. A nonprofit organization must report raffle prizes if the amount a person paid for the chance to win a prize is $600 or more or if the payout is at least 300 times the amount of the wager.
• Raffle Rules: The Raffle is subject to these Official Rules. These Official Rules cannot be changed by any oral statement made by any employee, consultant or agent acting on behalf of Maine Hockey Club. By entering the Raffle, entrants accept and agree: (1) to be bound by these Official Rules and the decisions of Maine Hockey Club, which shall be final and binding; (2) waive any right to claim ambiguity in the Raffle or these Official Rules; (3) that Maine Hockey Club may use the entrant’s name, photograph, likeness, statements, or voice for promotional or advertising purposes in connection with the Raffle in all forms of media, now or hereafter known, in perpetuity, without review, permission or further compensation, except where prohibited by law.
BY ENTERING THE RAFFLE, EACH ENTRANT RELEASES MAINE HOCKEY CLUB, ITS BOARD MEMBERS, EMPLOYEES, AND VOLUNTEERS. THEIR AFFILIATES AND ALL OF THEIR OFFICERS AND VOLUNTEERS FROM ANY AND ALL LIABILITY FOR INJURIES, LOSSES OR DAMAGES OF ANY KIND (INCLUDING WITHOUT LIMITATION, ATTORNEY’S FEES) CAUSED BY PARTICIPATING IN THE RAFFLE OR WINNING ANY PRIZE OR RESULTING FROM ACCEPTANCE, POSSESSION, USE OR MISUSE OF ANY PRIZE AND EACH WINNER AGREES TO INDEMNIFY AND HOLD MAINE HOCKEY CLUB HARMLESS FROM ANY AND ALL LOSSES, DAMAGES, RIGHTS, CLAIMS AND ACTIONS OF ANY KIND ARISING FROM, IN CONNECTION WITH, OR AS A RESULT OF PARTICIPATING IN THE RAFFLE OR THE WINNER’S ACCEPTANCE OR USE OF ANY PRIZE. A RAFFLE ENTRANT’S SOLE AND EXCLUSIVE REMEDY FOR ANY CLAIM AGAINST MAINE HOCKEY CLUB ARISING OUT OF THE SALE OF TICKETS OR THE CONDUCT THE RAFFLE SHALL BE LIMITED TO THE RETURN OF THE PURCHASE PRICE PAID FOR THEIR TICKET(S). IN NO EVENT SHALL MAINE HOCKEY CLUB, ITS BOARD MEMBERS, EMPLOYEES, OR VOLUNTEERS BE LIABLE TO ANY PARTY FOR ANY LOSS OR INJURIES TO EARNINGS, PROFITS OR GOODWILL, OR FOR ANY INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES OF ANY PERSON OR ENTITY WHETHER ARISING IN CONTRACT, TORT OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, ANY CONTROVERSY OR CLAIM ARISING OUT OF OR RELATING TO THE RAFFLE OR THESE OFFICIAL RULES SHALL BE SETTLED BY BINDING ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION (PURSUANT TO ITS EXPEDITED PROCEDURES) UNDER ITS COMMERCIAL ARBITRATION RULES AND CONDUCTED IN CHICAGO, ILLINOIS. JUDGMENT ON THE AWARD RENDERED BY THE ARBITRATOR MAY BE ENTERED IN ANY COURT HAVING JURISDICTION THEREOF.
